Terms of Service

These Terms of Service ("Terms") govern your use of the WaterDamageResponse247 website and contractor-matching service ("Service"). By using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

What we are — and what we are not

WaterDamageResponse247 is a matching service. We are not a contractor. We do not perform restoration, inspections, or estimates, and we do not employ, supervise, or control any contractor. We facilitate introductions between homeowners and independently owned, licensed, insured contractors who may be able to help with water damage restoration, mold remediation, or related services.

No endorsement or guarantee

While we apply reasonable screening criteria in selecting contractors for our network, we do not endorse any specific contractor and make no representations or warranties about the quality, timeliness, pricing, warranty terms, or workmanship of any contractor's services. The contractor you hire is solely responsible for the work performed. You are responsible for independently evaluating any contractor, verifying their credentials, requesting written estimates and warranties, and satisfying yourself before authorizing any work.

No professional advice

Content on this website — including educational articles, warning signs, typical price ranges, timelines, and warranty descriptions — is for general informational purposes only and does not constitute engineering, legal, financial, insurance, or real-estate advice. Your responsibilities

You agree to provide accurate information when submitting a request, to use the Service only for legitimate property restoration needs, and to comply with all applicable laws. You acknowledge that submitting a request authorizes contractors in our network to contact you by phone, SMS, and email regarding your restoration needs.

Disclaimer of warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

Limitation of liability

To the fullest extent permitted by law, WaterDamageResponse247 shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from or in connection with: (a) your use of the Service; (b) any services performed or not performed by any contractor; (c) any dispute between you and a contractor; or (d) any property damage, personal injury, or financial loss arising from restoration work. Our total aggregate liability to you for any claim arising out of or relating to the Service shall not exceed one hundred U.S. dollars ($100).

Indemnification

You agree to indemnify and hold harmless WaterDamageResponse247, its affiliates, and its service providers from any claim, loss, or expense arising from your use of the Service, your contract or interaction with any contractor, or your breach of these Terms.

Intellectual property

All content on this website — including text, graphics, logos, and software — is the property of WaterDamageResponse247 or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without prior written permission.

Governing law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in Delaware, except where applicable consumer-protection law provides otherwise.

State-specific consumer rights

New Jersey residents. Pursuant to the Truth in Consumer Contract, Warranty, and Notice Act (TCCWNA), N.J.S.A. 56:12-14 et seq., nothing in these Terms shall be construed to limit, waive, or violate any right available to New Jersey consumers under New Jersey law. Provisions herein limiting warranties or liability shall not apply to New Jersey consumers to the extent such limitations are prohibited by N.J.S.A. 56:12-14 et seq. or other applicable New Jersey statute.

Connecticut residents. Connecticut residents have the right under Public Act 23-56 to revoke any consent provided to WaterDamageResponse247 within twenty-one (21) days of submission, without cause and without affecting any service already requested. Revocation may be made via the opt-out channels in our Privacy Policy or by emailing [email protected].

Massachusetts residents. WaterDamageResponse247 is a lead-generation service subject to the consumer-protection provisions of MGL Ch. 93A and MGL Ch. 159C. Massachusetts residents may exercise revocation rights at any time through the channels described in our Privacy Policy.

New York residents.New York residents are protected by General Business Law § 399-p and related Department of Public Service rules governing telephone solicitation and consent. Nothing herein limits any New York consumer's statutory right to revoke consent or to seek the protections of those statutes.

California residents. California residents have specific rights under the California Consumer Privacy Act (CCPA/CPRA, Cal. Civ. Code § 1798.100 et seq.) including the right to know, delete, correct, and opt out of the sale or sharing of their personal information. See our Privacy Policy and the Do-Not-Sell section for full details and exercise mechanisms.

Texas residents. Texas residents are protected by the Texas Business & Commerce Code § 302 and the Texas Data Privacy and Security Act (TDPSA, 2024).

Pennsylvania residents. The Pennsylvania Telemarketer Registration Act (73 P.S. § 2241 et seq.) protects Pennsylvania residents from unsolicited telephone solicitation and provides revocation rights honored at any time.

Illinois residents.The Illinois Restricted Call Registry Act (815 ILCS 305) governs telephone solicitation to Illinois residents. Nothing in these Terms waives Illinois residents' rights under that or related Illinois consumer- protection statutes.

Colorado residents. The Colorado Privacy Act (C.R.S. § 6-1-1301 et seq.) and Colorado No-Call List (C.R.S. § 6-1-308) provide Colorado residents with comprehensive privacy and telephone-solicitation protections.

Virginia residents. The Virginia Consumer Data Protection Act (VCDPA, Va. Code § 59.1-575 et seq.) and the Virginia Telephone Privacy Protection Act (Va. Code § 59.1-510) grant Virginia residents rights similar to CCPA.

Ohio residents. The Ohio Consumer Sales Practices Act (ORC § 1345 et seq.) and ORC § 109.87 protect Ohio residents and are enforceable by the Ohio Attorney General.

Michigan residents. The Michigan Home Solicitations Sales Act (MCL § 484.125 et seq.) and Michigan Telemarketing Sales Rule give Michigan residents full revocation rights, including a 3-business-day cancellation right on certain home-solicitation contracts.

For all residents: nothing in these Terms is intended to waive any non-waivable consumer-protection right available under the law of your state of residence.

Changes to these Terms

We may update these Terms from time to time. The updated version will be posted with a new "Last updated" date. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
